These Terms of Service govern your use of fashionrose.shop and purchases made from Fashion Rosé. The store is operated by Sidane LLC, trading as Fashion Rosé, registered under trade licence number 2542890.01 and VAT number 105371001600001 at Sharjah Media City (Shams Free Zone), Al Bataeh, Sharjah, United Arab Emirates (“Fashion Rosé”, “we”, “us” or “our”).

1. Eligibility and acceptance

By using the website or placing an order, you confirm that you have legal capacity to enter into a contract in your jurisdiction and that the information you provide is accurate. If you do not agree to these Terms, do not use the website.

2. Products

We take reasonable care to describe and display products accurately. Colours and details may vary slightly because of screens, lighting and manufacturing tolerances. Measurements are approximate unless stated otherwise. Product availability may change without notice.

3. Prices and payment

Prices are displayed in the currency selected or shown on the website. Applicable taxes, shipping charges and other charges collected by us are shown before you place the order. Where import duties or taxes are not collected at checkout, they may be payable to local authorities or carriers. Payment must be authorised using a method offered at checkout.

4. Orders and contract formation

An order is an offer to buy. An automated acknowledgement does not necessarily mean that we have accepted it. A contract is formed when we confirm acceptance or dispatch the goods, depending on applicable law. We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing error or lack of stock. If we cancel after payment, we will refund the amount charged.

5. Shipping

Delivery methods, estimates and restrictions are described in our Shipping Policy, which forms part of these Terms. Risk remains with us until the goods are delivered to you or a person you nominate, except where applicable law provides otherwise.

6. Returns, refunds and consumer rights

Returns and refunds are governed by our Returns and Refund Policy. Nothing in these Terms excludes mandatory rights concerning cancellation, withdrawal, faulty goods, conformity, legal guarantees or remedies available in your country.

7. Accounts and acceptable use

You are responsible for keeping account credentials confidential. You must not misuse the website, introduce malicious code, interfere with its operation, scrape it unlawfully, attempt unauthorised access, use it for fraud, or infringe another person’s rights.

8. Intellectual property

The website’s branding, copy, photographs, graphics, design and software are owned by or licensed to Fashion Rosé and are protected by applicable intellectual-property laws. You may use the website only for personal, non-commercial shopping purposes. No rights are transferred to you except as expressly stated.

9. Reviews and other submissions

Content you submit must be truthful, lawful and not infringe third-party rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting the store, subject to applicable privacy and consumer laws. We may remove unlawful, abusive, irrelevant or fraudulent content.

10. Third-party services

The store is hosted by Shopify and may use third-party payment, delivery, tracking and review services. Third-party links and services may have their own terms. We are not responsible for independent third-party services, but this does not reduce any responsibility we cannot lawfully exclude.

11. Disclaimer and liability

We do not guarantee that the website will always be uninterrupted or error-free. To the fullest extent permitted by law, we are not liable for indirect or unforeseeable losses that are not caused by our breach. We do not exclude liability where exclusion is unlawful, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer remedies.

12. Privacy

Our processing of personal information is described in our Privacy Policy and Cookie Policy. Cookie choices may be changed using the “Cookie preferences” link on the website.

13. Changes

We may update these Terms prospectively. The version published when you place an order will normally govern that order, unless a change is required by law. Material changes will be communicated where required.

14. Governing law

These Terms are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Sharjah. This choice does not deprive a consumer of mandatory protections or access to competent courts available under the law of their country of residence.
